ENCENITAS
REGULATIONS
If you’re thinking about building an ADU in Encinitas, it’s important to know the local rules before starting. These regulations help make sure your project fits with city standards, boosts your property’s value, and supports long-term housing needs. Encinitas is actively encouraging ADU development as a housing solution, so being informed helps you move smoothly through the process and make the most of your property.
WHAT CAN I BUILD?
MAX SIZES
Detached ADUs can be up to 1,200 sq ft or the size of the main home—whichever is smaller.
Attached ADUs can be up to 1,200 sq ft or 50% of the main home (minimum ranges from 850 to 1,000 sq ft depending on layout).
SETBACKS
Side and rear setbacks are reduced to 4 ft. Front setbacks follow standard zoning rules.
TWO STORY ADUS
Two stories are allowed if full setbacks are met. Height limits are 16 ft with reduced setbacks, and up to 18–20 ft near high-quality transit.
BUILDING SEPARATIONS
Detached ADUs must be at least 6 ft from other structures (4 ft eave-to-eave).
HOW LONG WOULD IT TAKE?
PERMIT TIMEFRAME
Permits are typically issued within 60 to 90 days. Coastal properties or projects with multiple revisions may take 4 to 6 months.
COASTAL OR OTHERS?
If your property is in the Encinitas Coastal Zone, a no-fee Coastal Development Permit is required and is processed together with your building permit.
